Foreword
The Stendhal Boutique is an electronic commerce site accessible on the Internet (www.stendhal-beauty.com).
This site is published by Stendhal Society, a simplified joint stock company with a capital of 152.500 euros euros whose registered office is located at 76/78 Avenue des Champs
Elysées 75008 PARIS, registered in the Trade and Companies register of
Paris under number 392 557 203.
This on-line sale site offers cosmetic products and accessories of Stendhal brand and is open exclusively to users of the network. The proposed
products are reserved for these users' personal use, without direct
connection with their professional activity, as supplements to the care
provided and the sales made in the authorized point of sale.
Any order for any products on this site shall be deemed an unconditional acceptance of these General Terms of Sale.
Any
confirmation of the order form shall constitute an electronic signature
that will have the same value, between the parties, as a manual
signature.
The Stendhal Boutique reserves the right to modify these General Terms of Sale at any time and
these General Terms of Sale shall apply solely to sales made after the
said modification.
The products
The offers included in the site are subject to availability from stock.
The prices
The prices mentioned in the site are stated in euros inclusive of tax and exclusive of postage expenses.
Postage expenses shall be charged over and above and shall be mentioned at the time of final confirmation of the Order.
Prices are subject to variations.
Any products ordered shall be invoiced at the price in force at the time of confirmation of the Order.
Orders and invoices
The user may browse freely around the site and discover the various products offered for sale by the boutique of Stendhal, authorized distributor of STENDHAL SAS.
After the user has registered on the site and confirmed the
registration, the ordering process is materialized on line by a
succession of pages showing the various steps to be followed by the user
to confirm the order:
- consult items on sale;
- add items to the shopping bag (clicking to the right of each product, on the 'add' icon);
- view "my bag" (clicking on the image "my bag");
- confirm the order (clicking on the button "confirm my order");
- enter the invoicing and delivery addresses and other information (e.g.: gift wrap, card);
- recapitulation of the order and assignment of an order number;
- click on the button "secured payment" to go to the secured site of CIC (payment secured by SSL encryption);
- CIC form to be filled in – Card number, expiry date, (CIC site);
- payment confirmation (CIC site);
- assignment of a transaction number if payment is confirmed (CIC site);
- optional return via a link (from the CIC site) to www.stendhal-beauty.com for acknowledgements or other.
The order may only be paid by credit card (CB-Visa / Eurocard / Mastercard).
Delivery / Reception of the products
Our sales and prices are established for product departure from Pacy-sur-Eure (27120 ) France.
The products shall be delivered at the delivery address specified at
the time of confirmation of the order by the buyer, and shall be shipped
within an average time period of five working days.
The
Company shall not be held liable for any unreasonably late deliveries
if the delay is attributable to the common carrier, to the loss of
products ordered or to a strike.
Upon reception of the order, the
buyer must verify the conformity of the products received. Any anomaly
should be notified within 48 hours of the reception date, by e-mail at www.stendhal-beauty.com.
The number of the order and of the transaction shall be mentioned in the notification.
General observation
Claims that will not mention the number of the order and the number of the transaction (secured payment) shall not be taken into consideration.
Rétractation
The Customer shall have a period of 7 working days, starting from the date of reception of the items, to cancel the order if the Customer so wishes, subject to returning the item in its original package unaltered, complete with the form provided, to the warehouse of the boutique of Stendhal, at the following address:

The Company shall reimburse the products within a period of 30 days, to the exclusion of the postal charges.
Liability
It is agreed expressly between the parties that, should the boutique of Stendhal be held liable for total or partial failure to fulfil its obligations, the boutique's liability shall not exceed an amount equal to the amount of the corresponding product that caused the damage.
Freedom of information and protection of privacy
The information collected within the framework of the distance sale are
both mandatory and essential for handling, delivering and invoicing the
orders.
All this information is treated as strictly confidential.
As
provided for in law no. 78-17 of 6 January 1978 concerning information
treatment, files and freedom, the treatment of the individual
information collected on the Site has been declared to the French
Commission on the freedom of information and the protection of privacy.
The User has the right to access, modify, rectify and suppress his/her
personal data. To exercise this right, the User should send a postal
mail to the Customers department of the Institute at 199 rue St Honoré
75001 Paris, France.
Intellectual Property
All items contained in the site www.stendhal-beauty.co is protected by copyrights, mark or patent rights.
The
Company reserves the right to claim for damages in case of infringement
or breach of its intellectual and industrial property rights.
Jurisdiction
These General Terms of Sale are governed by French law. In case of dispute, the Courts of Paris shall have sole jurisdiction; however, in case of non-payment, the boutique of Stendhal shall be free to refer the matter to the courts having jurisdiction over the domicile of the Customer.
